Terms and Conditions

These Terms and Conditions govern your use of the website located at josephinefarm.ca and your purchase of products, tickets and services from Josephine Farm Inc.

In these Terms and Conditions, “Josephine Farm,” “we,” “us” and “our” refer to Josephine Farm Inc., operating as Josephine Flower Farm. “You” and “your” refer to the person using our website, placing an order or making a reservation.

By accessing our website, placing an order, purchasing a ticket or booking a service, you agree to these Terms and Conditions and any additional policies, product details or agreements that apply to your purchase.

Please read these terms carefully before completing your purchase.

1. About Josephine Farm

Josephine Farm is a seasonal flower farm located in Lincoln, Ontario. We offer farm-grown flowers, bouquets, seasonal flower shares, bulk flowers, floral gifts and accessories, workshops, U-Pick experiences, photography sessions, wedding and event florals, rentals and other seasonal products and experiences.

Our products, services, opening dates and availability may change throughout the year.

2. Eligibility to Purchase

You must be at least 18 years old or have the permission of a parent or legal guardian to place an order or enter into an agreement through our website.

A parent or legal guardian must complete any required waiver, consent or booking documentation for a guest under 18.

Additional age, supervision and participation requirements may apply to farm visits, workshops and other experiences.

3. Use of Our Website

You may use our website for lawful, personal and non-commercial purposes.

You may not:

  • use the website for unlawful, fraudulent or misleading purposes;

  • provide false or inaccurate information;

  • impersonate another person;

  • interfere with the operation or security of the website;

  • introduce viruses, malicious code or other harmful material;

  • copy, reproduce or commercially use our website content without permission; or

  • use our content, images, branding or product designs to create or promote a competing business.

We may restrict or terminate access to the website where we reasonably believe these terms have been violated.

4. Product Information and Availability

We make reasonable efforts to ensure that product descriptions, photographs, prices and availability are accurate. However, our flowers and many of our products are seasonal, agricultural and handmade.

Product photographs are intended to represent the general size, style, character or colour palette of an item. Your order may not look exactly like the photograph shown.

Actual colours may also vary because of natural differences, lighting, photography and screen settings.

All products and services are subject to availability. We may limit quantities, discontinue products or decline an order that we are unable to fulfil.

5. Seasonal Flowers and Substitutions

Our fresh flowers are affected by seasonality, weather, temperature, crop performance, pests, disease and other growing conditions outside our complete control.

Specific flower varieties, colours and stem combinations cannot be guaranteed unless they are expressly confirmed in writing.

When a flower or material is unavailable, we may make substitutions using flowers or materials of comparable quality, value and overall design character. We will make reasonable efforts to preserve the agreed size, style and colour direction of the order.

Natural variations in colour, shape, texture, maturity and stem length are part of working with farm-grown, dried and preserved flowers and are not considered defects.

6. Prices and Taxes

All prices are listed in Canadian dollars unless otherwise stated.

Applicable taxes, shipping charges, delivery fees, travel charges, rental fees and other applicable costs will be shown at checkout, on the product page or in your written proposal.

Prices and availability may change without notice before an order is placed.

If a product is listed at an obviously incorrect price because of a technical or administrative error, we may contact you to offer the correct price or cancel and refund the affected order.

Promotional offers and discount codes are subject to their stated terms and cannot be combined unless expressly permitted.

7. Orders and Order Acceptance

Submitting an order and receiving an automated email does not necessarily mean that we have accepted or can fulfil the order.

An order is subject to:

  • successful payment;

  • product or flower availability;

  • accurate customer information;

  • applicable ordering deadlines;

  • delivery or pickup availability; and

  • our ability to reasonably fulfil the order as described.

We may decline or cancel an order because of unavailable inventory, crop conditions, an incorrect price, suspected fraud, payment failure, delivery limitations or an error in the product listing.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled portion of the order.

8. Customer Information and Order Accuracy

You are responsible for reviewing all order details before completing checkout, including:

  • product and quantity;

  • size and colour selection;

  • names, wording and spelling;

  • personalization details;

  • event date;

  • pickup date and location;

  • shipping or delivery address;

  • recipient information; and

  • contact information.

Please contact us promptly if you discover an error.

Changes cannot be guaranteed after an order has entered production, flowers or supplies have been reserved, personalization has begun or an order has been shipped.

Additional charges may apply to approved changes.

9. Personalized and Made-to-Order Products

Personalized and made-to-order products may include petal pouches, ribbon products, ring pillows, signs, labels, keepsakes and other custom items.

You are responsible for carefully reviewing all names, dates, wording, quantities, colours and other submitted details.

Where a digital proof is provided, production will begin only after approval unless otherwise stated. Approval confirms that the wording, spelling, layout and supplied information are correct.

Customer-approved errors are not eligible for a complimentary replacement or refund.

Minor variations in colour, placement, natural materials and handmade construction may occur and are not considered defects.

10. Processing Times

Processing times vary by product and are shown on the applicable product page.

Processing time refers to the time needed to prepare, harvest, personalize or package an order. It does not include shipping transit time.

Personalized, handmade and made-to-order products generally require more processing time than ready-made products.

Order deadlines are based on the event or required date provided by the customer. Customers are responsible for ordering early enough to allow for both processing and delivery.

11. Local Pickup

Available pickup dates, times and locations will be shown on the applicable product page or at checkout.

You are responsible for collecting your order at the location and during the pickup period selected.

Another person may collect the order on your behalf if they have the order name or confirmation information.

Fresh flowers and other time-sensitive products may not be suitable for extended storage. We cannot guarantee the quality or availability of an order that is not collected during its scheduled pickup period.

An uncollected perishable or custom order may not be eligible for a refund.

Responsibility for the care, transportation and condition of the product passes to you when it is collected.

12. Local Delivery

Local delivery may be available for selected products and locations.

Delivery fees and available delivery areas will be shown at checkout or included in a custom proposal.

You are responsible for providing a complete address, access instructions, telephone number and any information needed to complete delivery safely.

Delivery times are estimates unless a specific time has been expressly confirmed in writing.

When no recipient is available, we may leave an order in a reasonably safe location if conditions permit. Once an order has been delivered as instructed, the customer is responsible for protecting it from heat, cold, rain, wind, animals, theft and other environmental conditions.

Additional charges may apply for redelivery caused by an incorrect address, unavailable recipient, restricted access or incomplete instructions.

13. Shipping

Eligible non-perishable products may be shipped within Canada where shipping is offered at checkout.

Shipping charges are calculated based on the delivery address, parcel dimensions, weight and selected shipping service.

Fresh flowers and other temperature-sensitive products are not shipped unless shipping is specifically offered on the applicable product page.

Once your order has shipped, you will receive a confirmation email. Tracking information will be included when it is available through the selected shipping service.

Carrier delivery times are estimates and are separate from our processing times. We cannot guarantee delivery on a particular date unless that service has been expressly confirmed.

We are not responsible for delays caused by the carrier, weather, transportation interruptions, peak-season volume, labour disruptions or other circumstances outside our reasonable control. We will, however, provide reasonable assistance in reviewing a delayed or missing shipment.

14. Shipping Addresses and Returned Packages

You are responsible for providing a complete and accurate shipping address.

Please contact us immediately if an address needs to be corrected. We cannot guarantee that an address can be changed after an order has been packed or transferred to the carrier.

If a package is returned because of an incorrect or incomplete address, refusal, failure to collect it or another circumstance outside our control, additional shipping charges may apply before it can be sent again.

Personalized, made-to-order or time-sensitive products may not be refundable if they cannot be resold or delivered in time for their intended use.

15. Damaged, Defective or Incorrect Orders

Please inspect your order promptly after pickup or delivery.

For a damaged, defective or incorrect non-perishable item, contact us within 48 hours of delivery or pickup.

For fresh flowers, contact us within 24 hours of delivery or pickup.

Please provide:

  • your name and order number;

  • a description of the concern;

  • clear photographs of the product;

  • photographs of the packaging, where applicable; and

  • any other information reasonably required to assess the issue.

Please retain the product and packaging until we have reviewed your request.

Where a claim is approved, the available remedy may include a replacement, repair, store credit, partial refund or refund, depending on the product, circumstances and availability.

Natural flower variation, minor handmade variation, customer-approved personalization and damage caused after pickup or delivery are not considered defects.

Nothing in this section limits any rights or remedies available under applicable law.

16. Returns and Exchanges

Return eligibility depends on the type of product purchased.

Unless otherwise stated:

  • fresh flowers and other perishable products are final sale;

  • personalized and made-to-order products are final sale;

  • tickets, reservations and registrations are governed by the cancellation terms stated on the applicable booking page;

  • gift cards are final sale except where otherwise required by law; and

  • rental items are governed by the applicable rental terms or agreement.

Eligible standard, unused and non-personalized merchandise may be returned within 14 days of receipt, provided it is unused, undamaged and in its original packaging.

You must contact us before returning an item. Unauthorized returns may not be accepted.

Unless the return is required because of our error or a defective product, the customer is responsible for return shipping costs. Original shipping charges are not refundable.

Nothing in our return policy limits a customer’s rights under applicable consumer-protection law.

17. Fresh-Flower Care

Fresh flowers are living, perishable products. Vase life varies by flower variety, maturity, temperature, transportation, water quality and care.

Customers are responsible for following the care instructions provided with the flowers or published in our Flower Care Guide.

We cannot guarantee a specific vase life unless expressly stated.

Damage caused by heat, freezing temperatures, lack of water, improper storage, delayed pickup or failure to follow care instructions is not considered a product defect.

18. Seasonal Flower Shares and Subscriptions

The details of each seasonal flower share or subscription—including bouquet quantity, size, schedule, pickup location and frequency—are stated on the applicable product page.

Unless expressly described as automatically renewing, a seasonal share ends after the selected number of bouquets has been provided.

Flower varieties will change throughout the season and substitutions may be made based on field availability.

Subscribers are responsible for collecting their bouquets during the designated pickup period.

Missed pickups are not generally refundable or replaceable because flowers are harvested and prepared specifically for the scheduled pickup.

Where permitted, you may arrange for another person to collect your bouquet.

Any change, transfer, pause or cancellation option will be described on the applicable product page.

19. Bulk Flowers for DIY Events

Bulk flower buckets contain a seasonal assortment of farm-grown flowers and foliage based on field availability and the product selected.

Quantity and arrangement guidance provided on our website is an estimate only. The number of arrangements that can be created depends on their size, fullness, style and the arranger’s technique.

Unless a specific colour palette has been confirmed, flower varieties and colours are selected based on the best available seasonal material.

After pickup or delivery, the customer is responsible for:

  • transporting the flowers safely;

  • keeping them cool and hydrated;

  • following conditioning and care instructions;

  • providing suitable buckets, workspaces and refrigeration where needed; and

  • completing the floral design and setup.

DIY flower purchases do not include floral design, installation or guaranteed design results unless those services are specifically included in writing.

20. Tickets, U-Pick Visits and Farm Experiences

Tickets and reservations are valid only for the date, time and experience booked.

Farm capacity is limited, and tickets are generally non-refundable unless otherwise stated on the applicable ticket page.

Where permitted, a ticket may be transferred to another person or moved to another available date in accordance with the terms stated when booking.

Guests should arrive close to their reserved time. Late arrival may reduce the amount of time available for the experience.

Visitors must:

  • follow staff directions and posted farm rules;

  • remain within authorized visitor areas;

  • supervise children as required;

  • use tools and farm facilities responsibly;

  • respect crops, wildlife, property and other guests; and

  • complete any required waiver or consent documentation.

We may refuse entry or require a person to leave if their conduct is unsafe, disruptive, abusive or contrary to farm rules. A refund may not be provided in those circumstances.

Farm visits involve natural agricultural conditions, including uneven ground, soil, gravel, mud, insects, plants, weather exposure and active farm operations.

The applicable ticket page and farm waiver contain additional terms.

21. Workshops

Workshop registration is subject to availability and any age or participation requirements shown on the workshop page.

Workshop fees cover only the materials, instruction and inclusions described in the listing.

Participants are responsible for arriving on time. Late arrival may result in missed instruction or reduced participation time.

Workshop tickets are generally non-refundable because supplies, flowers and staffing are prepared in advance.

Transfer, rescheduling and weather terms will be stated on the applicable workshop page.

Workshop results will vary according to the participant’s experience, preferences and technique. Images shown are examples and do not guarantee an identical finished arrangement.

22. Weather and Farm Closures

Many of our visits, workshops, photography sessions and events take place outdoors or depend on farm conditions.

We may continue operating during light rain or ordinary seasonal weather.

We may postpone, relocate, modify or cancel an experience where conditions are unsafe or unsuitable, including thunderstorms, high winds, extreme heat, flooding, poor field access, fire, power failure or other significant hazards.

When Josephine Farm cancels a ticketed experience, affected customers will be offered the remedy stated on the applicable ticket page, which may include rescheduling, account credit or a refund.

A customer’s decision not to attend because of ordinary weather conditions does not automatically entitle the customer to a refund.

23. Photography at the Farm

Casual personal photography is welcome during regular visits, provided it does not interfere with farm operations or the enjoyment of other guests.

Professional, portrait, engagement, wedding, commercial and styled photography sessions must be booked and paid for in advance through our Photography page.

Professional photographers and clients must follow all photography guidelines, access restrictions and booking terms.

A regular farm admission ticket does not include permission to conduct a professional or organized photography session.

24. Weddings, Events and Custom Floral Services

Wedding florals, event florals, private rentals, installation services and other custom work require a separate proposal, agreement or contract.

Submitting an inquiry does not reserve a date.

A date is confirmed only after the required agreement has been signed and the required payment or deposit has been received.

The separate agreement may contain terms concerning:

  • deposits and payment schedules;

  • floral substitutions;

  • design revisions;

  • guest counts;

  • delivery and setup;

  • travel fees;

  • installation and removal;

  • cancellations and postponements;

  • rental items;

  • venue access;

  • vendor requirements;

  • weather; and

  • events beyond reasonable control.

If a separate signed agreement conflicts with these general Terms and Conditions, the separate agreement will govern the applicable service.

Josephine Farm generally provides wedding and event floral services within approximately a 45-minute drive of our farm in Lincoln, Ontario. Service availability and travel fees depend on the venue, date and work required.

25. Rentals

Rental products may include vases, bud vases, floral vessels and other event items.

Availability is not guaranteed until the rental reservation has been confirmed.

Rental terms may include:

  • the rental period;

  • pickup and return dates;

  • deposits;

  • cleaning requirements;

  • late fees;

  • breakage or damage charges;

  • replacement costs; and

  • restrictions on adhesives, paint, wax or alterations.

The customer is responsible for rental items from the time they are collected or delivered until they are returned and inspected.

Lost, broken, damaged, altered or unreturned items may be charged at their full replacement value.

Large or custom rental orders may require a separate rental agreement.

26. Gift Cards and Promotional Offers

Gift cards may be used only toward eligible Josephine Farm products or services and are not redeemable for cash except where required by law.

Gift cards should be treated like cash. We are not responsible for a lost, stolen or unauthorized gift card except where required by law.

Discounts, promotional codes and special offers:

  • are valid only during the stated promotional period;

  • may apply only to selected products or services;

  • may be limited to one use per customer;

  • cannot be combined unless expressly stated; and

  • cannot be applied retroactively to previous purchases.

27. Intellectual Property

The website and its content are owned by or licensed to Josephine Farm Inc.

This includes our:

  • business names;

  • logo and floral icon;

  • photographs and videos;

  • product photographs;

  • website copy;

  • graphics and illustrations;

  • product designs;

  • workshop materials;

  • downloadable resources; and

  • website layout and branding.

You may view and print website content for your personal, non-commercial use.

You may not copy, reproduce, modify, publish, distribute, sell, license or commercially use our content without prior written permission.

28. Customer Reviews and Submitted Content

You may choose to provide a review, testimonial, photograph, comment or other content.

You confirm that content you submit:

  • is accurate to the best of your knowledge;

  • does not violate another person’s privacy or intellectual-property rights;

  • is not defamatory, unlawful, threatening or discriminatory;

  • does not contain malicious software or misleading promotional content; and

  • is based on your genuine experience.

By submitting a review or testimonial through a feature intended for public display, you grant us permission to display it in connection with our business.

We will seek appropriate permission before using identifiable customer or event photographs for broader promotional purposes unless the applicable booking agreement already provides that permission.

29. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment processors, shipping carriers, mapping services and social-media platforms.

Third parties operate under their own terms, privacy policies and service conditions.

We are not responsible for the availability, security, content or practices of an independent third-party website or service.

A link to another website does not necessarily mean that we endorse all of its content or services.

Our collection and handling of personal information is described in our Privacy Policy.

30. Website Availability and Errors

We make reasonable efforts to maintain an accurate and functioning website, but we do not guarantee uninterrupted or error-free access.

The website may occasionally be unavailable because of maintenance, service interruption, technical failure or circumstances outside our control.

We may correct typographical errors, inaccurate descriptions, availability information and other website errors when discovered.

Nothing on the website constitutes legal, medical, financial or other regulated professional advice.

31. Limitation of Liability

To the fullest extent permitted by law, Josephine Farm Inc. will not be liable for indirect, incidental, special, punitive or consequential losses arising from the use of our website or the purchase of a product or service.

Where liability cannot legally be excluded, our liability relating to a product or service will, to the extent permitted by law, be limited to the amount paid for the affected product or service.

This limitation does not apply where liability cannot be excluded or limited under applicable law.

Nothing in these Terms and Conditions limits any mandatory rights or remedies available to a consumer under applicable law.

32. Customer Responsibility

You are responsible for losses, damage or third-party claims resulting from your unlawful use of our website, deliberate misconduct, infringement of another party’s rights or material breach of these Terms and Conditions.

This section does not make you responsible for losses caused by Josephine Farm’s own negligence or breach of law.

33. Events Beyond Our Reasonable Control

Josephine Farm will not be responsible for a delay or failure caused by circumstances beyond our reasonable control.

These circumstances may include:

  • severe weather;

  • drought, flooding or crop failure;

  • plant pests or disease;

  • fire;

  • power, water or refrigeration failure;

  • road closures;

  • transportation or shipping disruption;

  • supplier shortages;

  • labour disruption;

  • government orders;

  • public-health emergencies; or

  • other events that could not reasonably have been prevented.

Depending on the affected product or service, we may offer a substitution, revised delivery date, postponement, account credit or refund.

Any remedy remains subject to the applicable product terms, separate agreement and consumer-protection law.

34. Privacy

Our collection, use and disclosure of personal information are governed by our Privacy Policy.

By using our website or placing an order, you acknowledge that you have had the opportunity to review that policy.

35. Governing Law

These Terms and Conditions are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Any dispute will be subject to the courts of Ontario, unless applicable consumer-protection law provides otherwise.

Before starting formal proceedings, we encourage you to contact us so that we can attempt to resolve the concern directly.

36. Changes to These Terms

We may update these Terms and Conditions periodically to reflect changes to our products, services, website or legal obligations.

The revised version will be posted on this page with a new “Last updated” date.

Unless otherwise required by law, changes will apply to purchases made after the revised terms are posted. The terms in effect when an existing order or booking was completed will generally continue to apply to that transaction.

37. Separate Policies and Agreements

These Terms and Conditions should be read together with any applicable:

  • Privacy Policy;

  • Shipping Policy;

  • Refund and Returns Policy;

  • ticket or workshop terms;

  • U-Pick waiver and consent form;

  • photography guidelines;

  • product-page conditions;

  • wedding or event floral agreement;

  • property or event rental agreement; and

  • rental-item agreement.

Where a signed agreement contains terms that differ from these general Terms and Conditions, the signed agreement governs the applicable booking or service.

38. Severability and Waiver

If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in effect.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
